障害年金の給付制限

障害年金の支給要件を満たしていたとしても、
すでに障害年金を受給している人であったとしても、
次のような場合には障害年金の全部または一部が支給停止となります。
①故意の事故により障害となった場合
⇒アルコール中毒による精神障害は、アルコールを摂取すること自体は合法
ですので、給付制限はありません。
②故意の犯罪行為により障害となった場合
⇒例えば、覚醒剤使用により障害が発生した場合が該当します。
ただし、覚醒剤であっても自己の意思によるものではなく、脅迫や暴力に
より強制的に中毒にされた場合は故意ではないと判断されることがあります。
③自己の重大な過失により障害となった場合
④正当な理由がなくて療養に関する指示に従わないことにより、障害となり、
または障害の程度を増進させ、または障害の回復を妨げた場合
⇒年金事務所などの役所は障害年金請求者や受給権者に協力を求める権限を
もっています。職員の質問に答えなかったり書類の提出指示に従わない
ときには、給付制限の対象となります。
