第三者の行為が原因で障害年金を受けた場合の調整について

第三者の行為によって障害が生じた場合に障害年金を受給したときは、
その障害年金の金額の範囲で受給者が第三者に対して有する損害賠償の請求権
を障害年金の保険者が取得することになります。
実務上は、障害年金を受ける前に第三者から損害賠償を受けることが多いため、
その場合は損害賠償の金額分障害年金が支給停止となります。
つまり、加害者や自賠責保険から損害賠償を受けていれば、
その損害賠償の範囲内で障害年金は支給停止になるということです。
ただし、この損害賠償額には医療費や葬祭費、見舞金などは含まれません。
また、損害賠償額が大きい場合であっても、障害年金が支給停止となるのは
最大で2年間となります。
なお、第三者行為により障害年金を受ける場合は、
次の書類を年金事務所等に提出する必要があります。
●第三者行為事故状況届
●交通事故証明、または事故が確認できる書類
●確認書
●所得証明等
●損害賠償金の算定書
